Khums

In Islam, khums (Arabic: خُمْس‎ Arabic pronunciation: [xums], literally 'one fifth') refers to the required religious obligation of any Muslims to pay one-fifth of their acquired wealth from certain sources toward specified causes. It is treated differently in Shia and Sunni Islam. This tax is paid to the imam, caliph or sultan, representing the state of Islam, for distribution between the orphans, the needy, and the [stranded] traveler.In Sunni Islam tradition, the scope of khums tax has been ghanim, which is defined as the spoils of war.

Such amount is an income like any other income you get, which can be utilized  for your livelihood along with your family and any reasonable expense. If on the day of your yearly Khums, any thing remains from it, just like any lawful income, that remaining amount will be applicable for Khums calculation.

Simply calculate your earnings then minus your lawful expenses and calculate what remained, then pay the Khums which is 20% of what remained from the earrings of every year.

Usual use of the cloth does not mean wearing it once or twice. Usual use means wearing it as one of your cloth which you usually wear.

If an item is not usually used for one year or more, then Khums is applicable on it or it's current value.

Donations which were already given are part of the expenses. Whatever amount which has been donated and given has gone out of your ownership, so there is no Khums on you for that donation because it has been given away and does not belong to you any more.

Your father did his duty by paying khums on what was liable for him. Once he transferred that amount to you, it now becomes your responsibility. In regards to gifts and khums, this depends on taqleed, so you will need to refer to your Marja' taqleed to see if khums is liable on gifts.

The property where you reside at as your home is exempted from Khums as far as you reside at it. The property which became a rental property must be calculated in your Khums.

Your near family members e.g. your parents, your wife and your children must be supported financially by you from your own money and it is not allowed to give them from Khums.

Other poor relatives can be helped from your own money and it will from the best charity. If you can not help them from your own money, you can give them from Sadat share if they are deserving pious needy Sadat. If they are not Sadat and need help and no one is ready to help them, then you can seek permission from Marje' of Taqleed to help them from Sahm e Imam (AS).

If you need to buy a house for livening in it and not for investment, and you have legally and islamically entered in the purchase agreement but the completion (full payment) was after your date of Khums, then the amount of the completion of the purchase is not under your free ownership because you have a binging agreement to pay. This makes that amount out of Khums calculations of that year because it was already committed for buying a house to live in.

If the saved money came from an income out of which Khums has been paid, then no Khums again on such amount. But if the saved money came from a source of income with out paying its Khums, then Khums on that part of the savings remains obligatory.

Khums is only obligatory on money and wealth but in every material we own which is more than our lawful expenses. Non monitory money which are not used for one year from the time of getting it, must be calculated according to current market rate, then khums must be paid out of it. If you keep the gift unused to gift it to others, there is Khums on you as far as you give it others before completing one year from owning it. If one complete year passes and the gift is unused and belongs to you,bayou will then to pay the Khums of its current value of 20% of the material itself.

If your husband gives you pocket money to keep for you or spend as you want, then this means that the money is yours. Such money owned by you is your responsibility and any remaining amount of it must be applied for Khums.

If your husband gives you the money to keep it for home expenses to be made on his behalf, then such money is still his money but kept with you. In such case, no Khums on you because your husband is still the owner of that amount.

If they have shown you a written ijazah of them being able to receive khums from the Marja', or you are of the level of trusting the individual in what they are saying about their receipt and its authority, then that would suffice. 

If not, request a receipt from the office.

The requirement of A.U. Seyid Sistani's office is that whenever you give a khums payment, a receipt must be issued from the office.
