Khums

In Islam, khums (Arabic: خُمْس‎ Arabic pronunciation: [xums], literally 'one fifth') refers to the required religious obligation of any Muslims to pay one-fifth of their acquired wealth from certain sources toward specified causes. It is treated differently in Shia and Sunni Islam. This tax is paid to the imam, caliph or sultan, representing the state of Islam, for distribution between the orphans, the needy, and the [stranded] traveler.In Sunni Islam tradition, the scope of khums tax has been ghanim, which is defined as the spoils of war.

If the money was earned by your husband during the same year of Khums, then no Khums on that earning, but if it was earned before one year or more, then Khums is applicable on it.

Khums is a wajib duty applied to every mukallaf. Once you reach the age of taklif, you are independently responsible for your wajibaat. If you  meet the requirements of khums, then you must pay it, regardless of whether you are financially dependent on someone else or not. 

As for gifts, you will need to refer to your Marja' taqleed, to see if according to him, khums is applicable on gifts. According to A.U. Sistani, it is. 

So, if your khums day comes, and you have yet to use that gift, or you have savings, then you need to pay its khums.

If the jewellery has been used, there is no khums on it, but for the coins, if they are of common use, that would be a part of savings, if not used, and you must refer to the detailed laws of that.

Khums must be paid in its due time, without delay, and one must fulfil what is in their dhimmah, so as to not fall in sin and to make what they purchase from that due money halal and not usurped. 

The solution to this, if someone is not able to pay the complete amount or any amount in its due time is to do what we call a Muṣālaḥa.

A Muṣālaḥa is a mutual agreement and solution agreement between the mukallaf and the Marja' taqleed or his wakeel. 

What happens is the mukallaf speaks to his/her Marja' or his wakeel, and explains that they cannot pay their due khums, and it is transferred in a technical way from khums to a long-term or short-term loan. The mukallaf will then be responsible to honour the loan and it is to be given whenever they are able to.

By doing this, the mukallaf will be free of khums payment until that time, and their money will be halal.

So, best thing to do is to speak to the local wakeel of your Marja'.

It is obligatory to pay the Khums as soon as possible with out any delay. If you are in a place where you can not deliver the Khums to the Marje' of Taqleed or any trusted person who is authorised by the Marje' to receive, means that you no way to deliver the Khums, then you can wait but try your best to find a safe way to deliver as soon as you can. Delaying or postponing Khums delivery with out serious reason is not allowed.

1. Investing in the stock market is allowed as far as you avoid the shares or bonds of unlawful business like usury, alcohol, sinful films, gambling etc.

2. Khums is obligatory on your wealth on the your date of Khums. You must calculate the real market value of your stocks on your date of Khums.

Khums is not our money and it is not like charity which we have the choice to whom we give. Khums is the right of others which is an Amanah with us which we must give it to its owners. Half of the Khums is called Sahm e Sadat which is the right of needy Sadat believers, and the other half is called Sahm e Imam which should be given to deputy of the Imam (AS) who is the Marje’ of Taqleed.

‘If your needy relatives are Sadat, then you can give them from Sahm e Sadat. If they are not Sadat, then you need to seek permission from the Marje’ of Taqleed to give part of the Sahm e Imam to your needy relatives.
